Accessing, browsing and using this website (the "Site"), operated by International Lawyer (the "Firm", "we", "us"), whose parent entity and holding structure is incorporated in the State of Wyoming, United States of America, constitutes full and unreserved acceptance of these Terms of Use (the "Terms"), as well as of the Privacy Notice and the Professional Notice, which form an integral part hereof. If you do not agree with any of their provisions, you must refrain from using the Site.
Use of the Site is reserved for persons over eighteen (18) years of age with full legal capacity. By using it, you represent and warrant that you meet this condition and that, when acting on behalf of a legal entity, you hold sufficient authority to bind it to these Terms.
Acceptance of these Terms occurs upon your first access to the Site and is renewed on each subsequent access. We recommend that you keep or print a copy of the version in force at any given time.
The purpose of the Site is to present institutional information about the Firm, its practice areas and its international legal, immigration, corporate, tax, wealth, private-investigation and document-management consulting services, provided to individuals and legal entities through its operations centers and its network of independent collaborating partners across multiple international jurisdictions.
The Site also includes informational content (the "Legal Intelligence" blog), a contact form for requesting consultations, and a voluntary subscription newsletter.
The actual engagement of any professional service is always formalized through a separate written agreement (engagement letter, services agreement or equivalent document) detailing the scope of the engagement, the fees, the jurisdiction of performance, the responsible professional and the particular conditions applicable. In the event of any discrepancy between such agreement and these Terms, the services agreement shall prevail in all matters relating to the engaged work.
Law is essentially territorial: regulations vary substantially between jurisdictions, are subject to frequent reform, and their application depends on factual circumstances that can only be assessed through individualized professional analysis. The information published may not reflect the latest legislative, regulatory or case-law developments, and may not be applicable — or may even be counterproductive — in your jurisdiction or your particular situation.
Accordingly, you agree not to make decisions of legal, tax or economic significance based solely on the content of the Site, and to obtain advice from professionals duly licensed in the competent jurisdiction before acting. The Firm disclaims all liability for decisions made in disregard of this warning.
Browsing the Site, reading its contents, downloading materials, submitting the contact form, sending emails, subscribing to the newsletter or booking a free initial consultation do not, by themselves, create an attorney–client relationship, nor a professional engagement, mandate, agency or analogous relationship with the Firm or its collaborating partners.
A professional relationship arises solely and exclusively when the following occur cumulatively: (a) the Firm's prior verification of the absence of conflicts of interest; (b) the Firm's express written acceptance of the engagement; and (c) the execution by both parties of the corresponding services agreement. The Firm reserves the right to decline any engagement without any obligation to state reasons.
Until the engagement is formalized, please refrain from sending confidential, privileged or sensitive information that is not strictly necessary for the preliminary assessment of the matter. Information sent unilaterally and unsolicited does not create a heightened duty of confidentiality beyond what the law requires, nor does it prevent the Firm — within applicable ethical limits — from accepting engagements from third parties in related matters.
You agree to use the Site diligently, lawfully and in accordance with these Terms, good morals, public order and applicable law. By way of illustration and without limitation, the following is expressly prohibited:
The Firm reserves the right to restrict, suspend or block access to the Site, without prior notice, for any user who breaches these conditions, and to disregard manifestly abusive consultation requests, without prejudice to any civil or criminal actions available at law.
All content on the Site — including, by way of illustration, texts, articles, guides, analyses, trademarks, trade names, logos (including the Firm's emblem), graphic design, interface, navigation structure, source code, style sheets, iconography, photographs and illustrations — is the exclusive property of the Firm or its licensors, and is protected by national and international intellectual- and industrial-property law, including the treaties administered by WIPO and the copyright legislation of the United States and the other applicable jurisdictions.
Access to the Site does not grant the user any license, assignment or exploitation right over such content, beyond a limited, revocable, non-exclusive and non-transferable authorization to view it and, where applicable, print it for strictly personal, private and non-commercial use, provided that all ownership notices remain intact.
Any other reproduction, distribution, public communication, making available, transformation, extraction or reuse, in whole or in part, requires the Firm's prior, express, written authorization. Unauthorized use will give rise to the liabilities provided by law, including claims for the damages caused.
The information and documentation you submit through the Site's forms or any other channel must be truthful, accurate, complete and up to date, and must not infringe third-party rights or applicable law. You are solely responsible for the data you provide, for holding the necessary authorizations to disclose it, and for the consequences of its inaccuracy or unlawfulness.
The processing of the personal data you submit is governed by our Privacy Notice. Notwithstanding the foregoing, by submitting non-confidential suggestions, comments or improvement ideas about the Site, you grant the Firm a free, worldwide, non-exclusive license to use them for the purpose of improving its services.
The Site integrates services provided by independent third parties — including font-delivery services and, where applicable, form-delivery and measurement tools — and may contain links to third-party websites. Such services and sites are governed exclusively by their own terms of use and privacy policies, which the user must review and accept independently.
The Firm does not control, supervise or assume any responsibility for the availability, content, privacy practices, security or operation of third-party services and sites, or for damages arising from their use. The inclusion of links does not imply approval of, sponsorship of, or association with the owners of the linked sites.
The Firm endeavors to keep the Site continuously available and to apply reasonable, state-of-the-art security measures. However, it does not guarantee the absence of interruptions, errors, harmful components or technical incidents, nor the compatibility of the Site with all devices and browsers.
We reserve the right to temporarily suspend access — with or without prior notice — for maintenance, security, updating or improvement reasons, and to modify, replace or remove content, features or the configuration of the Site itself at any time. The user is responsible for having adequate tools to detect malicious software and for the security of their own equipment.
To the fullest extent permitted by applicable law, the Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including — by way of illustration only — the implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, non-infringement, and freedom from errors or harmful components.
The foregoing is without prejudice to any warranties that cannot be waived under the mandatory consumer-protection rules applicable to the user in their jurisdiction of residence, which remain unaffected by this clause to the extent such rules so require.
To the fullest extent permitted by applicable law, neither the Firm nor its officers, employees, agents or collaborating partners shall be liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for loss of profit, loss of business, loss of data or reputational harm, arising from: (a) the use of, or inability to use, the Site; (b) decisions made by the user on the basis of information published on it without a formalized professional engagement; (c) failures, interruptions, errors or omissions of the Site; or (d) unauthorized access to, or alteration of, the user's transmissions or data by third parties.
Where, under applicable law, the Firm's liability cannot be excluded but may be limited, the Firm's total aggregate liability arising from the use of the Site shall be limited to one hundred U.S. dollars (USD 100). This limitation does not apply to liability arising from willful misconduct or gross negligence, or to liability that cannot be limited under mandatory rules, including — where applicable — the consumer-protection laws of the user's place of residence.
Liability arising from professional services actually engaged shall be governed exclusively by the corresponding services agreement and by the professional-liability rules and regimes applicable in the jurisdiction of the engagement.
You agree to indemnify and hold harmless the Firm, its officers, employees, agents and collaborating partners from and against any third-party claim, demand, penalty, loss, damage or expense (including reasonable attorneys' fees and court costs) arising from: (a) your breach of these Terms; (b) your unlawful use of the Site; (c) your infringement of third-party rights, including intellectual- and industrial-property rights and privacy rights; or (d) the inaccuracy or unlawfulness of the information you provide.
You may not assign or transfer your rights or obligations under these Terms without the Firm's prior written consent. The Firm may freely assign its contractual position to any entity within its group or to a third party in the context of corporate reorganizations, mergers, acquisitions or asset transfers, without diminishing the user's safeguards.
The Firm may amend these Terms at any time to adapt them to legislative, case-law, technical or operational developments. The version in force shall be the one published on the Site at any given time, indicating its date of last update. Substantial changes will be reasonably highlighted. Use of the Site after the publication of amendments implies their acceptance; if you do not agree, you must cease using the Site.
The foregoing is without prejudice to: (a) any non-waivable rights that mandatory consumer-protection rules grant the user in their jurisdiction of residence, including, where applicable, the right to litigate before the courts of that place; and (b) the law and forum specifically agreed by the parties in professional services agreements, which may differ from those provided herein in view of the jurisdiction of performance of the engagement.
The Firm may nevertheless seek, before any competent jurisdiction, such injunctive or protective measures as may be necessary to protect its intellectual- and industrial-property rights.
Before initiating any court action, the parties shall attempt in good faith to resolve the dispute amicably through direct negotiation for a minimum period of thirty (30) calendar days from written notice of the dispute. If no agreement is reached within that period, the route provided in the preceding clause shall be available.
To the fullest extent permitted by applicable law, any action arising from the use of the Site must be brought in an individual capacity, and you waive any right to participate in class or collective actions against the Firm in connection with disputes relating to the use of the Site. This waiver shall not apply where mandatory rules prohibit it.
If any provision of these Terms is declared void, unlawful or unenforceable by a competent court, such provision shall be deemed deleted or construed in the manner that best preserves its purpose, and the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Notice and the Professional Notice, constitute the entire agreement between the user and the Firm regarding the use of the Site and supersede any prior agreements or communications on the same subject.
The Firm's failure to exercise any right or power provided in these Terms shall not constitute a waiver thereof, nor prevent its subsequent exercise.
These Terms are published in Spanish and English. Both versions carry equivalent informational value; however, in the event of any discrepancy or doubt of interpretation between them, the English version shall prevail, as the language of the Firm's jurisdiction of incorporation.
